Motion to modify subpoena is GRANTED; the court finds the subpoenaed docs appear are voluminous, excessive, unduly burdensome and oppressive.  The subpoena is modified as follows:

1.  #s 1 – 12 are modified; the requested documents are limited to 1/1/2009 to present;

2.  #s 2, 4, 7, 8, 9, 10, 11, and 12 modified; the requested documents shall exclude documents related to Pet/H’s parents and siblings. 

3.  #s 1 -11 are modified; the requested documents shall exclude documents related to businesses known as Drew Partners LP and JD & Sons, Inc.

Motion to Compel: moving party Pet/H is asserting RP/W partially complied as to requests for production  and seeks further responses & sanctions.     

Ruling:

  1. RP/W shall produce her 2012 and 2013 tax returns (#1);
  2. Resp/W shall produce documents described within #5, 6, 7, 8 10-13, 16-19. 
  3. Deny request for further response to demand #2;  
  4. RP/W shall produce her 2013 and 2014 earnings statements (#3). 
  5. W shall produce the missing pages of the 2/15 I&E (#14). 
  6. If W had health insurance in 2016, she shall comply and produce docs responsive to #15. 
  7. Deny evidence sanctions. 
  8. Reserve over CCP monetary;
    1. CCP 2031.310(h) states the court shall impose a monetary sanction against any party who unsuccessfully opposes a motion to compel a further response, unless it finds that the one subject to the sanction acted with substantial justification or that other circumstances make the imposition of the sanction unjust.  However, the motion must be accompanied by a dec setting forth facts supporting the amount of any monetary sanction sought. CCP 2023.040. 

                                          i.    MP has not provided such a dec; he simply requests $5,220.  No compliance with CCP 2023.040.  Issue reserved.
