Ability to Pay Determinations for Infractions 

FINANCIAL HARDSHIP

MyCitations is an online system that offers individuals the option to request a reduction for their infraction citation, particularly in cases where there is financial need. If you have a financial hardship and can show that you are unable to pay the full amount for a qualifying citation, you may request the court to consider your ability to pay. You may ask the court for a lower fine, payment plan, community service and/or more time to pay by completing the Ability to Pay form. A court official will review your request and the judgment/order will be sent to you via email or by USPS mail. 

ELIGIBLE REQUESTS

The following requests may be made through the “MyCitations” tool:

  • Request a reduction to your ticket
  • Request a payment plan
  • Request community service
  • Request more time to pay your ticket

OTHER REQUESTS
The following requests should be made through the My Court Portal website and not the “myCitations” tool: 

  • Contest your ticket
  • Provide proof of correction in exchange for a dismissal or reduction of those charges
  • Request to attend traffic school. If your case is eligible for traffic school, you must first have your case approved for traffic school prior to requesting a fine reduction through the My Court Portal

REQUEST UNDER REVIEW

The Court may take up to 30 days to provide a ruling on an Ability to Pay request. While a request is pending, you will not be able to make a payment or schedule a hearing until a ruling has been issued.

If you are currently on a payment plan that is in good standing and you submit a request, your payment plan will be canceled, and no further payments will be accepted and processed until a ruling is issued by a judicial officer.

MYCITATIONS EXCLUSIONS

 The “MyCitations” tool will not allow users to submit a request if their case is ineligible. The following will disqualify the case from the Ability to Pay determination request process:

  • A misdemeanor or felony charge exist on the case
  • The balance on the case is less than $20
  • The case has closed
  • There is an active warrant on the case
  • There is an active order to complete Community Service in lieu fines/fees on the case
  • The case is currently on appeal
  • A Trial By Declaration has been submitted and is currently under review
  • A request for an Ability to Pay determination has been submitted and is currently under review. Only one request may be submitted at a time.
  • A future hearing scheduled
  • Mandatory appearance is required on one or more violations
  • The case contains one or more violations with mandatory proof of correction
  • An owner’s responsibility citation was issued to a business
  • The case includes one or more of the following infraction violations: Vehicle Code 27360(a), 27360(b), 27360.5(a), and/or 27360.5(b)

To determine if your case is eligible, access My Court Portal as a guest or register as a user. If your case is eligible, the portal will enable the available options and you will be directed to the “MyCitations” tool, where you can submit your request.
