Getting to Trials – The Court requires full compliance with Local Rule of Court 709 prior to setting a Trial date. 

Remote Appearances – Only if a request is filed and the Order is granted by the Court.

Ex Partes — Parties to comply with Local Rule of Court 704.

Second Call — 10:00 AM. Requesting party shall notify the other party IN ADVANCE. DV hearings and special set/long cause hearings may NOT be placed on second call.  Matter may go off-calendar if there are no appearances and/or contact by 10:00 AM.

MSC — Trials and Mandatory Settlement Conferences are set at court’s discretion, and only when all parties are in agreement.  A joint statement of issues must be filed prior to receiving a trial or MSC date.

RFO — Parties to comply with Local Rule of Court 705.

Financial Issues — Parties to comply with Local Rule of Court 702.

Continuances for RFOs, Motions and Conferences — The Court will entertain only 1 telephonic continuance pursuant to stipulation of both parties. Any request to continue beyond that will require a showing of good cause by appearing in person at the time of the hearing. The continuance date must be approved by the Court.

Trials The Court requires full compliance with Local Rule of Court 709 prior to setting a Trial date.  As to trial, the Court requires strict compliance with Local Rule of Court 709 and Local Rule of Court 714.  Should the parties wish to submit a trial brief, the Court requires compliance with Cal. Rule of Court Rule 5.394. Failure to comply with any of these rules may result in the matter being continued and/or monetary sanctions.

Continuance for Trials and Special Sets — May be granted by written request only by agreement and upon a showing of good cause as determined by the Court. Otherwise, an appearance is required.

Remote Appearances  Parties to comply with Local Rule 719.  Any party or witness appearing remotely must conduct themselves as if they are physically present in court.  They must have reliable internet access with video and audio via the Zoom platform, must not be in a moving vehicle, and must dress appropriately for court. Any party calling a remote witness must provide the witness with any exhibits in advance and/or be prepared to confront the witness with exhibits remotely via the electronic evidence portal and Zoom platform.

Hearing Rules 

  1. The Court expects counsel to be familiar with and follow the California Attorney Guidelines of Civility and Professionalism (the “Civility Guidelines”).
  2. A copy of the Civility Guidelines may be obtained on the web at the following URL: Attorney Civility and Professionalism | The State Bar of California
  3. Uncivil or unprofessional behavior will not be tolerated.
  4. The Court expects parties to resolve all disputes regarding scheduling or time extensions without the necessity of Court involvement.

All filings must be filed and served prior to any hearing date pursuant to applicable code.

General Information

Court Hours

  • Morning Session: Monday through Friday, 9:00 a.m. – 12:00 p.m.
    (15-minute recess)
  • Afternoon Session: Monday through Friday, 1:30 p.m. – 4:30 p.m.
    (15-minute recess)

Check-In Procedures

  • Counsel and self-represented parties must check in with the Bailiff upon arrival.
  • Counsel is requested to provide business cards to the Bailiff.

Calendar Call

  • There is no formal calendar call.
  • Parties and counsel must notify the Bailiff whether they are ready to proceed or require additional time to meet and confer.

Remote Appearances

Requests must be made in writing:

A “Notice of Remote Appearance” (Judicial Council Form RA-010) (RA-010 NOTICE OF REMOTE APPEARANCE), and “Order Regarding Remote Appearance” (Judicial Council Form RA-020) (RA-020 ORDER REGARDING REMOTE APPEARANCE) must be filed with the Court, stating the basis for the remote appearance request, and notice must be given to all parties entitled to receive notice of the proceedings. [Orange County Superior Court Local Rules, rule 719]  

Pursuant to California Rules of Court, rule 3.672:

  • Non-evidentiary or non-trial proceedings:
    The notice must be filed and served at least two (2) court days before the hearing, provided the party seeking to appear remotely gave or received notice of the proceeding at least three (3) court days before the hearing.
  • Evidentiary hearings or trials:
    The notice must be filed and served at least ten (10) court days before the hearing or trial. If the hearing or trial is set on shorter notice, the notice must be filed and served at least two (2) court days before the proceeding.

Court Discretion

The Court reserves the discretion to require an in-person appearance if it would materially assist in the determination, management, or resolution of the proceeding. (CRC rule 3.672(d).)


Continuances

Unopposed Requests

For unopposed requests for continuance, telephonic appearances are permitted. The courtroom clerk may assist counsel or self-represented parties informally and off the record.


Requests for Order (RFO)

Meet and Confer Requirement

Prior to any RFO hearing, parties must meet and confer in good faith regarding all issues raised and exchange all documentary evidence upon which they intend to rely, consistent with California Rules of Court, rule 5.98.

Support Matters

In any matter involving child support, spousal support, or domestic partner support, counsel is encouraged to have a proposed Xspouse calculation prepared for the hearing.

Income and Expense Declarations

Current Income and Expense Declarations (Judicial Council Form FL-150) must be filed and served with all Requests for Order and Responsive Declarations when relevant to the relief requested or when support is at issue. (CRC rule 5.92(b).)

Page Limitations

Unless otherwise permitted by the Court:

  • Declarations attached to an RFO or Responsive Declaration may not exceed ten (10) pages.
  • Reply declarations may not exceed five (5) pages.

These limits do not apply to:

  • Expert declarations
  • Income and Expense Declarations and attachments
  • Financial Statements and attachments
  • Property Declarations and attachments
  • Exhibits
  • Memoranda of Points and Authorities

(CRC rules 5.111(a) and 5.112.)


Mandatory Settlement Conferences (MSC) and Trial Requirements

Mandatory Settlement Conferences

The following documents must be exchanged and filed at least five (5) calendar days before the MSC (Local Rule 707):

  • Mandatory Settlement Conference Brief
  • Statement of Issues
  • Updated Income and Expense Declaration

All documents must be filed in Department L66.


Trials and Contested Hearings

Electronic Evidence Portal

Unless otherwise ordered by the Court, all exhibits must be uploaded through the Electronic Evidence Portal.

If the Court requires hard copies of exhibits, the original exhibit binders for the Court and copies for the witness stand must be organized, tabbed, and delivered to the department on the day of trial or hearing.

Only the Exhibit List is to be filed with the Court, and it must correspond to the tabbed exhibits contained in the binders. If any changes are made to the exhibits before the hearing or trial, an amended Exhibit List must be filed.

The Electronic Evidence Portal and related instructions are available on the Court’s public website:

Trial Documents

Unless otherwise ordered by the court, the following must be filed and served at least ten (10) calendar days prior to the trial (Local Rule 709):

    1. Motions in Limine (must be in writing)
    2. Joint statement of issues to be tried
    3. Exhibit list
    4. Current and complete Income and Expense Declaration (Form FL-150)
    5. Witness list in compliance with Family Code §217(c)
    6. Expert reports

Trial briefs must be served and filed no later than five (5) court days before the hearing. (CRC rule 5.394.)

All documents must be filed in Department L66.


Interpreters

Court-provided interpreters are available only for domestic violence matters.

For non-domestic violence matters, parties and counsel are responsible for arranging their own certified or qualified interpreters.

Matters may be continued if an interpreter is not available.


Child Custody Mediation Requirement

This requirement does not apply where:

  • A Domestic Violence Restraining Order is currently pending; or
  • A Domestic Violence Restraining Order has been issued.

If child custody or parenting time is disputed, the parties must participate in mediation through Family Court Services before the hearing.

A mediation appointment will be provided to the moving party before the hearing date is assigned.

If the parties resolve the issues before mediation:

  • Both parties and/or counsel must notify Family Court Services to cancel the appointment.
  • An appointment will not be canceled or rescheduled based on notice from only one party.

Failure to appear for mediation, or failure to timely cancel a mediation appointment after resolution, may result in sanctions of $100 per party. (Local Rule 703.)


Orders After Hearing

All proposed orders after hearing must comply with California Rules of Court, Rule 5.125.

Second Call: At 10:30 a.m., the requesting party shall notify the other party and the Court in advance. The Court may deny any request for a second call. Domestic Violence hearings and Trial/ Evidentiary hearings may not be placed on second call.

Remote Appearances: Parties must submit the RA-010 and RA-020 forms if they wish to appear remotely no later than ten (10) days prior to the hearing. Any party or witness appearing remotely must conduct themselves as if physically present in court. Parties must provide a specific reason in support of any request for a remote appearance.

MSC - Mandatory Settlement Conferences (MSC) must be held in person. Commissioners or Temporary Judges (TJs) are available upon request. Joint Mandatory Settlement Conference Briefs must be filed at least ten (10) calendar days prior to the meet-and-confer with the Commissioner or TJ.

Continuances for RFOs, Motions, and Conferences - Only two continuances will be granted by phone if requested by either party and both parties agree to the continuance. Any request to continue after the first two, even if uncontested, may require a showing of good cause and must be filed and served no later than five (5) court days before the scheduled hearing date, absent an emergency as determined by the Court. The new continuance date must be approved by the courtroom. See California Rule of Court 5.95.

Continuances for Trials and Evidentiary Hearings - The Court does not grant telephonic or stipulated requests to continue Trials or Evidentiary hearings absent a showing of good cause. If a Trial or Evidentiary hearing is continued, the Court will vacate the existing date and reset the matter for a Trial Setting Conference/Status Conference. At the Trial Setting Conference/Status Conference, the Court will provide the parties with a new Trial or Evidentiary hearing date.

Exhibits - This department utilizes the Electronic Evidence Portal for the submission of exhibits. All parties must upload and share any exhibits intended for use in their case-in-chief no later than 10 calendar days prior to the scheduled hearing. Rebuttal exhibits may be shared at the time the party forms the intent to use them.

Stipulations - Stipulations must be submitted in writing.

Contested Hearings/Trials - The Court requires strict compliance with Local Rule of Court 709 and Local Rule of Court 714. An exhibit list, witness list, a current and complete Income and Expense Declaration (FL-150) with supporting documentation, and a joint statement of issues to be tried must be filed no later than 10 calendar days before the trial or contested hearing. All exhibits for the trial or evidentiary hearing must be uploaded to the Electronic Evidence Portal at least 10 calendar days before the hearing. Should the parties submit a trial brief, it must comply with California Rule of Court 5.394.

Remote: Only if a request is filed and the Order is granted by the Court.  The Court has a strong preference for in-person appearances at trials, evidentiary hearings, and mandatory settlement conferences.

All filings must be filed and served prior to any hearing date pursuant to the applicable code.

Any party calling a remote witness must provide the witness with any exhibits in advance and/or be prepared to confront the witness with exhibits remotely via the electronic evidence portal and zoom platforms.

Exhibits: This department uses the Electronic Evidence Portal for exhibits. All parties must upload and share exhibits intended to be used in their case-in-chief to the evidence portal 10 days in advance of the date set for hearing. Rebuttal exhibits may be shared at the time the party forms the intent to use the exhibit. Parties are invited to bring 2 physical copies of exhibits for the Court's use.  If a party is unable to upload exhibits after reviewing the Court's instructions and contact the help line, then said party must bring 5 copies of exhibits to the hearing, in separate binders, with pre-marked exhibit tags and a corresponding exhibit list. Petitioner shall use consecutive numbers. Respondent shall use consecutive letters. Prior to the hearing parties are to meet and confer regarding potential stipulations to the admission of any exhibits. Any such stipulation must be in writing.

Stipulations: All stipulations must be in writing.

Continuances: TELEPHONIC CONTINUANCES ARE NOT ACCEPTED. May be granted by written request only by agreement (Form FL-308) and upon a showing of good cause as determined by the Court. Parties are to contact the department to obtain available continuance dates. Otherwise, an appearance is required.

RFO: Parties to comply with Local Rule of Court 705.

Financial Issues:  Parties to comply with Local Rule of Court 702.

Trials: The Court requires full compliance with Local Rule of Court 709 prior to setting a Trial date.  As to trial, the Court requires strict compliance with Local Rule of Court 709 and Local Rule of Court 714.  Should the parties wish to submit a trial brief, the Court requires compliance with Cal. Rule of Court Rule 5.394. Failure to comply with any of these rules may result in the matter being continued and/or monetary sanctions.

All filings must be filed and served prior to any hearing date pursuant to applicable code.

The Court has a strong preference for in-person appearances at trials, evidentiary hearings, mandatory settlement conferences.
